These terms apply to the services you book or receive from Fcar Pty Ltd (ABN 42 679 708 706) — “FCAR”, “we”, “us”, “our” — and to your use of our website at fcar-auto.com.au. By booking a service or using our website, you agree to these terms. Nothing in them takes away rights you have under the Australian Consumer Law.
FCAR offers three kinds of work:
Some work — in particular panel, paint and performance — is carried out by trusted specialists we coordinate. That work is covered by FCAR’s warranty, and you deal with FCAR as your single point of contact.
When you send a booking request — through our website, by phone, by text or by email — it is a request, not a confirmed booking. Your booking is confirmed once we contact you to agree a day and time. Please give us reasonable notice if you need to change or cancel.
For work on your own vehicle, the initial inspection is free. We diagnose the issue, explain it, and give you a written quote covering every part and every hour before we start. No work goes ahead until you approve the quote. If we find that further work is needed once we begin, we will contact you for approval before carrying it out.
A pre-purchase inspection is a separate, fixed-fee service. We will tell you the fee before you book. We inspect the vehicle and give you a written report on its condition at the time of inspection. The decision to buy the vehicle, and any negotiation with the seller, is entirely yours (see “Pre-purchase inspections” below).
We quote prices before we begin work, and we only carry out additional work with your approval. Unless we agree otherwise, payment is due on completion of the work. We will give you an invoice, which sets out how to pay. Prices include GST where it applies.
Every job we do carries a workmanship warranty. The length of the warranty depends on the work involved, and we tell you the period before we start. When the work is finished, we give you the warranty in writing as a separate document. This warranty is in addition to — and does not limit — your rights under the Australian Consumer Law.
A pre-purchase inspection report describes the condition of the vehicle at the time of our inspection, based on the checks we are able to carry out without dismantling the vehicle. It is not a guarantee of the vehicle, its history, or how it will perform in the future, and it does not cover faults that are not reasonably detectable during that inspection. We do not sell vehicles and have no interest in whether you buy — our role is only to inspect and report. The decision to buy, and any reliance you place on the report, is your own.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees. To the extent the law allows, our liability for a failure to comply with a consumer guarantee is limited to re-supplying the service, or paying the cost of having it re-supplied.
To the extent permitted by law, we are not liable for any indirect or consequential loss. Nothing in these terms limits any right you have under the Australian Consumer Law or other laws that cannot be excluded.
When you ask us to work on a vehicle, you confirm that you own it or are authorised to arrange the work. Please give us accurate information about the vehicle and the problem, and remove any valuables before you leave it with us.
The content of our website is owned by FCAR and provided for general information. We take care to keep it accurate but do not guarantee that it is complete or up to date. Our website may link to, or embed, third-party services such as maps; we are not responsible for their content.
We handle your personal information in line with our Privacy Policy.
If you are not happy with the work, the quote or the service, tell us and we will look into it. Email complaint@fcar-auto.com.au with your name, your vehicle, the invoice or booking date, and what went wrong. We will acknowledge your complaint and work with you to put it right. Nothing here limits your rights under the Australian Consumer Law, or your right to take the matter to Consumer Affairs Victoria.
We may update these terms from time to time. The current version will always be available on this page, with the date it was last updated shown at the top.
These terms are governed by the laws of the State of Victoria, Australia.
